Terms of Service
These Terms of Service ("Terms") govern your access to and use of Koda Rising ("Koda Rising", "we", "us"), an AI coding agent and access/billing layer for developers. By creating an account or using the service, you agree to these Terms.
1. The service
Koda Rising provides an AI coding agent, model routing, and prepaid billing designed to be affordable in local markets. We offer Individual, Teams, and Enterprise plans. Features, limits, and pricing may change as the product evolves, especially during early access.
2. Eligibility & accounts
You must be able to form a binding contract to use Koda Rising. You are responsible for your account credentials and for all activity under your account. Keep your credentials secure and notify us promptly of any unauthorized use.
3. Acceptable use
You agree not to use the service to build or distribute malware, to infringe others' rights, to violate applicable law, to attempt to circumvent usage limits or billing, or to resell access without authorization. We may apply reasonable rate limits and abuse protections.
4. Prepaid credits & billing
Paid usage runs on a prepaid balance denominated in Naira. You draw down credit as you use the agent, with a live usage meter so there is no monthly bill shock. Credits are generally non-refundable except where required by law. Taxes, where applicable, are your responsibility.
5. Your content & intellectual property
You retain all rights to the code, prompts, and content you submit ("Your Content"). We do not train our models on Your Content. You grant us a limited license to process Your Content solely to operate and provide the service to you. Output generated for you is yours to use, subject to these Terms.
6. Our intellectual property
Koda Rising, including its software, models routing, brand, and documentation, is owned by us and our licensors. These Terms do not grant you any rights to our trademarks or other intellectual property except as needed to use the service.
7. Early access & beta features
Some features are offered in early access and may be changed, limited, or discontinued. They are provided "as is" and may be less reliable than generally available features.
8. Disclaimers
The service is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. AI output can be incorrect; you are responsible for reviewing and testing code before relying on it.
9. Limitation of liability
To the maximum extent permitted by law, Koda Rising will not be liable for indirect, incidental, special, consequential, or exemplary damages, or for lost profits or data. Our aggregate liability is limited to the amounts you paid us in the three months before the event giving rise to the claim.
10. Suspension & termination
You may stop using the service at any time. We may suspend or terminate access for breach of these Terms, suspected abuse, or risk to the service or other users. On termination, your right to use the service ends; some provisions survive by their nature.
11. Governing law
These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict-of-laws principles. Disputes are subject to the courts located in Lagos, Nigeria, unless otherwise required by law.
12. Changes
We may update these Terms as the service changes. We will post the updated version with a new "last updated" date; continued use after changes means you accept them.
